Resolving a civil dispute through Alternative Dispute Resolution (ADR)
Alternative Dispute Resolution (ADR) is an effective method to settle civil disputes. It means a shorter timeframe to resolution and this means less costs for you. It also eliminates the stress and costs associated with a court hearing. When we meet with you, we will guide you through the best ADR process for you, whether that is by following the more formal route of Arbitration or taking the informal routes of Mediation and inter-party negotiation.
Resolving a civil dispute through Arbitration
During Arbitration an independent and legally qualified third party or member of the Chartered Institute of Arbitrators will make a legally binding decision on your case. We will work with you to prepare all the necessary documentation and evidence and represent your case to the Arbitrator.
Resolving a civil dispute through mediation
Often a civil dispute can be resolved through mediation. This is a method where an impartial third party Mediator facilitates a discussion between the claimant and the defendant. It is more flexible than a court hearing and its aim is to find an amicable settlement for both parties. Here at HRJ Foreman Laws Solicitors, we will work closely with you to prepare you for the mediation. We will also attend the mediation with you and advise you on the settlement proposals from the opposing party.
The Trusts of Land and Appointment of Trustees Act 1996
When a couple decide to separate or divorce, they can work with our expert team of family lawyers. However sometimes where the couple are cohabitees, the ways to determine the division of assets can become complex. We will always first consider if your dispute can be resolved through Alternative Dispute Resolution (ADR), such as by mediation, as this can result in a faster and more cost effective resolution for both parties.
Where ADR is not successful our civil litigators are experienced in supporting clients through claims brought under The Trusts of Land and Appointment of Trustees Act 1996 (TOLATA). It sets a framework to resolve disputes over the ownership or interests in land and property. Before you pursue your TOLATA claim, we will work with you to prepare the necessary documents and information required by the court and ensure that your case is clearly presented to outline your legal or beneficial rights. This will also include whether you wish to be removed from any mortgage or land ownership obligations in the future. If you need advice on a TOLATA or any other civil litigation matters contact us today.
